Willingness to sacrifice by an individual Association Member and fast action by our State Committee have rescued our suit against Secretary Galvin from an untimely end. Last month, your State Association officers had a telephone meeting with other plaintiffs and our most excellent pro bono attorneys at Foley Hoag.

By now, almost all of you will have received the December 2010 fund drive letter. We spent $640 to send it out. We followed up with an electronic email, and personal contact with a few long-time supporters.
We were looking for support for public outreach and candidate support. And we found it!
Thanks to incredibly generous support from major donors, in December we raised more than $2300 for our State PAC...so far. And $700 has found its way to our Federal PAC... so far. That's almost a five to one return on investment, far above what we have done in times past.

Readers will recall that in 2008, with the assistance of the ACLU of Massachusetts, and Boston Attorneys Foley, Hoag we successfully sued the Secretary of State, forcing him to use "Barr, Root" as the names on the general election ballot. After the election was over, he appealed. A three-judge panel from the Federal Circuit Court of Appeals heard his appeal, and sustained his position.
Our Attorneys on their recommendation asked for an en banc hearing (all fifteen judges on the Circuit); their request was denied. There are now several alternatives, including going through the state courts, appealing to the United States Supreme Court, or recognizing that there is now an unfair unambiguous rule.

State Committee Funds 2012 Presidential Ballot Access
The State Committee has set aside $1000 from our Federal account as a Presidential ballot access fund. Any donations specified as being for Presidential Ballot access will be added to the fund. The money may be spent on fundraising, petitioning, petition redistribution or other costs for getting our 2012 Presidential candidate on the ballot.
We improve our credibility as a third party if we run someone for President. (Yes, we would have been interested in running someone for statewide office this year on some ballot line, but we didn't find anyone willing to spend 15 or 20 thousand dollars out of their own pocket just to get on the ballot.)
The money will not be spent, except for raising more money, until we find someone who is willing to take full responsibility for executing the petitioning process.
